Articles of Anti-Phishing Alliance of China

Article 1: The full Chinese name of this Alliance is “中国反钓鱼网站联盟” (hereinafter referred to as “Alliance”) and its English name is “Anti-Phishing Alliance of China”, or “APAC” for short.

Article 2: Member units of this Alliance shall meet the following conditions:

  (1) Be willing to join this Alliance;

  (2) Abide by relevant laws and regulations issued by the state and recognize Articles of this Alliance.

Article 3: This Alliance shall carry out the following duties:

(1) Organize member units in finding out, governing and preventing from phishing sites, share relevant information concerning anti-phishing and promote construction of comprehensive governance system for anti-phishing.

(2) Organize and carry out investigation and research on anti-phishing, provide relevant business and policy consultation services for member units as well as offer decision support for relevant departments of government.

(3) Perform international exchange and cooperation concerning legislation research, technical application and standard formulation, etc. for anti-phishing. 

Article 4: Alliance members’ conference, held once or three times each year, shall be formed by delegates sent by member units and its duties shall be:

(1) Formulate and modify Articles of Alliance;                   

(2) Make decisions on important matters of this Alliance.

Article 5: Alliance Guidance Mechanism shall consist of Expert Steering Committee and Third-party Technical Recognition Mechanism. Expert Steering Committee shall be composed by experts in the internet industry and carry out guidance on operation of Alliance. Third-party Technical Recognition Mechanism shall be responsible for webpage preservation and technical recognition of phishing sites and put up with consultative advice on recognition of phishing sites. Third-party Technical Recognition Mechanism shall be composed by National Computer Virus Emergency Response Center and National Computer Network Emergency Response Technical Team/Coordination Center of China. 

Article 6: Secretariat under Alliance shall be responsible for daily work of Alliance, recognition and handling on phishing sites, conference convening and treatment of unexpected events, etc. and its headquarters is located in China Internet Network Information Center (CNNIC).

Article 7: Joining Procedures:

(1) Submit an application in writing for Members of Anti-Phishing Alliance of China;

(2) The application is published on the platform of Alliance after approval of Secretariat under Alliance.

Article 8: Withdrawal Mechanism:

  (1) Submit an application in writing for withdrawal and explain withdrawal reasons;

  (2) Publish it on the information platform of Alliance.

Article 9: Alliance members shall enjoy the following rights:

  (1) Enjoy the rights to report phishing sites to Alliance;

  (2) Enjoy the rights of all kinds of information services provided by Alliance;

  (3) Participate in exchange and study activities organized and arranged by this Alliance.

Article 10: Alliance members shall fulfill the following obligations:

  (1) Maintain legal interests of Alliance and its members;

  (2) Actively participate in working conference and all kinds of activities organized by Alliance;

  (3) Actively promote Alliance.

Article 11: These Articles shall come into effect as of the founding date of Alliance.
